APC CHIEFTAIN SEEKS NULLIFICATION OF ENUGU CONGRESS, DISQUALIFICATION OF UGO AGBALA AS CHAIRMAN IN ABUJA HIGH COURT

The Leadership tussle bedeviling the Enugu State Chapter of the All Progressives Congress APC has all but worsened as a Chieftain of the Party sues the Party, its former Enugu State Caretaker Committee Chairman, The independent National Electoral Commission and Barr. Ugo Agballa.

The plaintiff by name Uduji Kingsley had in a suit with number :FHC/ABT/65/1318/2021 dated 28th of October 2021 and filed in Federal High Court Abuja, sought an order for the Court to bar Ugochukwu Agballa from parading him self as the State chairman of APC in Enugu State as the purported election that produced him was illegal, null and void as well as contravened Section 85(3)of the electoral act as well as the constitution of the All Progressives Congress APC as amended in 2014.

The plaintiff sought for clarifications on whether a person who did not participate during the ward Congresses and stood as a state delegate could participate in the October 16 State Congress in contravention of the provisions of the constitution of the Party as amended in 2014.

He also seeks for clarifications as follows “whether the 1st Defendant can validly register as a member of the 3rd Defendant in July 2021 in Enugu State contrary to the article 9.4 of the Party’s constitution and also the 2021 3rd Defendant’s membership registration guidelines”

“Whether the 2nd Defendant or any person however described in Enugu State can validly register the 1st Defendant as a member of the 3rd Defendant after March 31st, 2021 closure of the membership registration of the 3rd Defendant”

The plaintiff is also seeking for 5 declarations of the Court that the 1st Defendant cannot validly contest the position of the chairman or any other position however described in the October 16, 2021 State Congress of All Progressives Congress APC

“A declaration that the 1st Defendant cannot participate in the October 16, 2021 State Congress of the 3rd Defendant as it contravenes Section 85(3) of the electoral act as well as the membership registration guidelines of the the 3rd Defendant”

“A Declaration that 2nd Defendant or any person however described in Enugu State, cannot register the 1st Defendant as a member of the 3rd Defendant after March 31st closure of the membership of the 3rd Defendant as it contravenes article 2, 7, 9.1 and 9.3 of the 3rd Defendants constitution. ”

” A declaration that : 2nd, 3rd and 4th Defendants cannot validly Recognise the 1st Defendant as the Enugu State chairman of the All Progressives Congress APC as it contravenes article 2, 7, 9.1, 9.3 and 7 of the constitution of the 3rd Defendant ”

” A declaration that the purported selection/election/declaration of the 1st Defendant as the duly elected chairman or Officer of the All Progressives Congress APC Enugu State contravenes the 2, 7, 9.1, 9.4, 12.7, 31.1 of the Constitution of the 3rd Defendant.
