Nurse Drags Civil Service Commission, Ministry Of Health, Others To Court Over Tutors’ Retirement Age

Assistant Director, Nurse Educator, Federal Ministry Of Health In Enugu, MRS. UGO C. ABBA has dragged the Civil Service Commission, Federal Ministry Of Health and Others to the Federal High Court of Nigeria, Enugu in a class action suit over implementation of the Harmonized Retirement Age for the Teachers.

Mrs. Ugo Abba in Suit No: FHC/E/CS/185/2022 is asking the court to interpret the new law enabling the teachers to serve for 40years, and until they turn 65years of age as it affects the Nurse Tutors/Educators in Nigeria.

In her words “We don’t know why the nurses are not enjoying 65years retirement age, where as our colleagues in the school of statistics are enjoying it and that is why I am in the court for our right”.

“Before going to court, I have written to the civil service commission, Ministry of Health and relevant authorities; yet, no feedback”

Meanwhile, speaking to News Center, Lawyer to the Plaintiff, CHIJIOKE DARLINGTON EZEH said his client is seeking for a court declaration “that by the widest construction of the Harmonized Retirement Age For Teachers in Nigeria Act, 2022 (as recently signed into Law by His Excellency President Muhamadu Buhari GCFR) and other relevant extant applicable Laws, the Applicant’ and all other persons belonging to her Class
and being “Registered Nurse Tutors/ Educators working with Institutions
under the Federal Ministry of Health are and should be considered as Education officers’ irrespective of their postings for the purpose of benefiting from the new retirement age of 65 years and length of service of 40 years’ as contained and envisaged under the
Harmonized Retirement Age For Teachers in Nigeria Act, 2022”.

“A DECLARATION that the Applicant’ and all other persons belonging to her Class
and being “Registered Nurse Tutors/ Educators working with Institutions
under the Federal Ministry of Heath are and should be considered as Chalk-in-Hand Teachers irrespective of their postings for the
purpose of benefiting from the new retirement age of 65 years and length of service of 40 years’ as contained and envisaged under the
Harmonized Retirement Age For. Teachers n Nigeria Act,2022”.

“AN ORDER compelling the Respondents acting by themselves, agents, servants etc to comply forthwith with the provisions of the
Harmonized Retirement Age for Teachers in Nigeria Act, 2022” among others

Eze noted that the defendants/respondents in the suit are;
1. THE HON. CHAIRMAN FEDERAL CIVIL SEVICE COMMISSION

  1. MINISTER FOR HEALTH

  2. FEDERAL MINISTRY OF HEALTH.

According to the our Correspondent, any ruling in favor of this class suit initiated by Mrs. Ugo Abba will likely help many nurse tutors or educators to keep their jobs, especially those at the verge of retirement either by year of service or by age.
